• For over 30 years, Mr. Kelly has engaged in successful, efficient litigation of disputes involving real estate, trust, and probate issues.  Even more important, he has used practical document drafting and effective strategizing, letter writing and negotiation to help innumerable clients avoid law suits entirely - - putting to rest the potential for endless contentiousness.

• His work has focused on the following areas:

REAL ESTATE:  Avoiding or resolving problems with contracts, sales, leases, lease options, easements, and similar documents.  Negotiation and, if needed, litigation of disputes over contract, title, co-ownership rights, partition actions, and accounting matters.

 

This office also drafts documents covering the real estate transactions mentioned above.

PROBATE and TRUST:   Negotiation and litigation to resolve disputes involving heirs, executors, administrators, trustees, and beneficiaries.  The disputes arise out of many types of claims, including undue influence, fraud, lack of capacity, breach of fiduciary duty, creditor claims, mismanagement of estates and will contests.  

 

Mr. Kelly also drafts wills and trusts and related documentation, including deeds and powers of attorney.  He also represents and counsels executors, administrators, trustees and conservators to assist them in carrying out their ordinary duties of administration and distribution of estate and trust property.

• Mr. Kelly's clients have come mostly from the California counties of San Francisco, Marin, Sonoma, Alameda, San Mateo, and Contra Costa, but he has litigated matters throughout both Northern and Southern California.
